45 Acre Parcel on Sterling Rd Sold to 40B Developer

Sale on May 15th puts the developer in control of the parcel where he was approved to build two large 40B projects in 2019.



On May 15th a 45 acre parcel on Sterling Road was conveyed to a corporation operated by Iqbal Ali, who's also the president of Crescent Builders.  The parcel is "34B" in the map below, off Sterling Rd.

            

 

For $850,000 the deed was transferred from Gail Kibourn (and the estate of David Kilbourn, who passed in 2019) to "ASN Group LLC":

             

According to the state corporation registry, the president of "ASN Group LLC" is Iqbal Ali.    Mr. Ali is also president of Crescent Builders.

            

Crescent Builders received comprehensive permits, recorded on July 29th, 2019, for two 40B projects on that parcel.  They had submitted two 40B projects  proposing a combination of housing at the site, including 96 rental units and 55 home ownership units.  ("Goodrich Brook Estates")   At the time the combined projects were anticipated to contribute 102 affordable housing units to Lancaster's inventory.

That comprehensive permit was appealed by a a group of residents including Victoria Petracca, who subsequently became chair of the town's affordable housing trust.  (Ms. Petracca lives about a half-mile as the crow flies from the project site.) That appeal is still active in the State Superior Court, as docket 1985CV01187.   They asserted that the Board of Appeals made a variety of errors in approving the permit.  

The last entry on the court website for the appeal docket says that it's been stayed pending the outcome of a MEPA determination, and that it will continue in September 2023.
